Overview

The practices set forth in this Privacy Policy apply to the services available under the domain and subdomains of www.tricomquest.com (collectively, the “Site”). This Privacy Policy describes the information, as part of the normal operation of our services, we collect from you and what may happen to that information. Although this policy may seem long, we have prepared a detailed policy because we believe you should know as much as possible about the practices of TriCom Quest (“the Company”) so that you can make informed decisions.

By continuing to access or use the Site, or signing up for the Company’s job placement services (“Service”) as either a job seeker or an employer, you signify your acceptance of this Privacy Policy, and you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the Company’s Terms and Conditions and other terms and conditions relative to the Site. This Privacy Policy is effective for all users.

What Personal Information Do We Collect?

When you sign up for the Service as a job seeker, we request or may request that you provide personal information, including your name, address, e-mail address, telephone number, social security number, resume, contact information, education, GPA, test scores, and any other information from which your identity is discernible. We may also collect demographic information that is not unique to you such as your ZIP code, age, preferences, gender, and interests. Sometimes we collect or may collect a combination of the two types of information.

When you sign up for the Service as an employer, we request or may request that you provide personal information, including your name, company name, address, e-mail address, telephone number, contact information, position title and department at your company, and any other information from which your identity is discernible. We may also collect demographic information that is not unique to you such as your ZIP code, age, preferences, gender, and interests. Sometimes we collect or may collect a combination of the two types of information.

We also gather or may gather certain information about your use of the Site and the Service, such as what areas you visit and which of the Company’s services you use. Moreover, there is information about your computer hardware and software that is or may be collected by us. This information can include without limitation your IP address, browser type, domain names, access times and referring Web site addresses, but is not linked to your personal information.

Our Use of Your Information

We use the information we gather on the Site, whether personal, demographic, collective or technical, for the purpose of operating and improving the Site and delivering the products and services that we offer.

If you have provided consent for us to do so, we may also use the information we gather to inform you of other products or services available from us or our affiliates.

We may use your contact information in order to send you e-mail or otherwise contact you regarding your job search, your profile, updates on the Site, or other matters pertaining to the Site or the Service. We may also provide additional communications, promotions and information on new opportunities and additional job postings that may be of interest to you. The nature and frequency of these messages will vary depending upon the information we have about you. In addition, you may receive free informational newsletters from us relating to topics that may be of special interest to you, such as career management advice.

We have areas on the Site where you can submit feedback. Any feedback you submit in these areas becomes the Company’s property, and we can use such feedback for marketing purposes or to contact you for further information.

Sharing And Disclosure Of Information With Third Parties

We do not provide your personal information to third parties without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is: 1) Reasonably necessary to offer our services; 2) Legally required; or, 3) Permitted by you. For example:

1. We disclose information to third parties if you consent to such disclosure. By signing up for the Service, you consent to the disclosure of your contact information, profile, resume, and other information about yourself that you provide to the Company to potential employers, who may then send you e-mail or otherwise communicate with you about potential job opportunities. Such disclosure made be made by posting your information in our searchable database for employers, and/or transmitted directly by us to employers we think might be interested in hiring you. We use data we have about you (including our subjective evaluation of you based on your interview, if applicable) to determine whether you might be interested in the opportunities of a particular employer.


2. We disclose information to companies and individuals we employ to perform functions on our behalf. Examples include hosting our Web servers, analyzing data, providing marketing assistance, and providing customer service. These companies and individuals will have access to your personal information as necessary to perform their functions, but they may not share that information with any other third party.


3. We disclose information if legally required to do so, if requested to do so by a governmental entity or if we believe in good faith that such action is necessary to: (a) conform to legal requirements or comply with legal process; (b) protect our rights or property or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public.


4. We disclose and transfer information to a third party who acquires all or a substantial portion of our business, whether such acquisition is by way of merger, consolidation or purchase of all or a substantial portion of our assets. In addition, in the event we become the subject of a bankruptcy proceeding, whether voluntary or involuntary, we or our trustee in bankruptcy may sell, license or otherwise dispose of such information in a transaction approved by the bankruptcy court. You will be notified of sale of all or a substantial portion of our business to a third party via email or through a prominent notice posted on the Site.

Other Uses of Information

We also share aggregated anonymous information about visitors to the Site with our partners and other third parties so that they can understand the kinds of visitors to the Site and how those visitors use the Site. We may also aggregate on an anonymous basis data regarding job qualifications, schooling, age, experience level or other information relevant to the job search or competition among job seekers for any such job. Such data may be made available to employers or fellow job seekers.

If you apply for a job position via the Site, you may be asked to provide information on your gender, race or other protected status where permitted by applicable law. Some employers are required by law to gather this information from job applicants for reporting and record-keeping requirements. You should understand that if provided, this information will be used by employers only in accordance with applicable law and will not be used in making any negative employment decisions. All information provided will be kept separate from your expression of interest in any job opportunity. Providing this information is strictly voluntary and you will not be subject to any adverse action or treatment if you choose not to provide this information. The Company does not discriminate on the basis of gender, race, color, national origin, religion, sexual orientation, or disability.

Personal Information on Resumes and Profiles

You may remove your resume and/or delete your profile from the Site at any time, but, employers, recruiters and others who have paid for access to the Company’s resume database or to obtain a copy of that database or have paid for access to the Service, as well as parties who have otherwise gained access, may have retained a copy of your resume or the Company profile in their own files or databases. We are not responsible for the retention, use or privacy of resumes or profiles in these instances.

Marketing Lists

From time to time, we obtain lists of people who may be interested in our products and services from third-party marketing list suppliers. We use these lists to send direct marketing promotions by mail. We do our best to only obtain these lists from suppliers who have opt-in policies for third-party marketing, but we are not responsible for the conduct and policies of these suppliers. Please note that even if you are a client of ours and have asked us not to use the information you provided to us to send promotional material, a third-party marketing list supplier could still provide us with your name and address, in which case you will receive the promotional material sent by us to others on the supplier's list. NOTICE TO/REGARDING CHILDREN UNDER THE AGE OF 13

The Company does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information on our Site or register for the Service. In the event that we learn that we have collected personal information from a child under age 13 we will delete that information as quickly as possible. CHILDREN BETWEEN THE AGES OF 13 AND 18

The Company does recommend that minors over the age of 13 ask their parents for permission before sending any information about themselves over the Internet.

Permission To Use Your Content

By transmitting any information, identification, suggestions, material, or other content (collectively, “content’) via the Site or otherwise to the Company, you automatically grant the Company the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, redistribute, transmit, perform and display such content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any rights that may exist in such content. Further, the Company is free to use any ideas, concepts, know-how, techniques and suggestions contained in any communications you send to this Site for any purpose whatsoever, including but not limited to creating, manufacturing and marketing products and/or services using such information, all without compensation to you.

What About Cookies?

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to enable our systems to recognize your browser and to provide features. The Site uses persistent cookies to identify members after their first visit. These cookies remain on the hard drive of a personal computer and may allow a member to enter the site without having to log in on every visit. To access any secure areas such as your account information, you must still enter your password. You can choose to disable cookies by deselecting that option under your browser preferences. When you disable cookies, you may not be able to fully utilize all the features and functions of the Site. Disabling cookies can also interrupt audio and cause breaks in navigation. When becoming a registered user of the Site, you can choose whether or not to accept the Site’s persistent cookie.

Access to and Modification of Your Information

You may review, correct, update or change your resume or other account information at any time. You may also opt out of receiving newsletters and certain other information from the Company.

We retain indefinitely all the information we gather about you in an effort to make your repeat use of the Site more efficient, practical, and relevant. Of course, you can delete your resume from the Site, and close your Company account at any time, in which event we will remove all our copies of your resume from the Site, and remove your Company profile and account information, except for an archival copy which is not accessible on the Internet.

How Secure Is Information About Me?

Although no use of the Internet is 100% secure, we work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input.

It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer. You are responsible for all actions taken with your credential and password, including fees charged to your account. Therefore we do not recommend that you disclose your Site password to any third parties. If you choose to share your credential and password or your personal information with third parties, you are responsible for all actions taken with your account and therefore you should review that third party’s privacy policy. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password.

Terms and Conditions and Other Notices and Revisions

If you choose to visit the Site or sign up for the Service, your visit and any dispute over privacy is subject to this Privacy Policy and our Terms and Conditions and other terms and conditions, including limitations on damages, and application of the law of the State of California. If you have any concern about privacy or terms of use of the Site or the Service, please contact us with a thorough description, and we will try to resolve it.

Our business changes constantly, and our Privacy Policy and the Terms and Conditions will change also. You should check the Site frequently to see recent changes. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account. We stand behind the promises we make, however, and do not intend to materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers. We may amend this Privacy Policy at any time by posting the amended terms on the Site. All amended terms shall automatically be effective ten (10) days after they are initially posted on the Site.
